David Smallbone reviews four recent cases in which the New South Wales Court of Appeal considers the construction, scope and application of dispute resolution clauses in commercial contracts, variously applied to choices of courts, expert determination and arbitration.
About David:
David Smallbone is a barrister with over 30 years’ experience representing clients in Australia and the Asia Pacific. David has considerable experience acting for, and advising, clients in complex, high value commercial and equity disputes. His busy practice sees him regularly appearing in multi-party and multi-jurisdictional disputes leading junior counsel, usually against Senior Counsel, in superior State and Federal courts in Australia. With a true global presence, David has also appeared in courts of the Pacific, namely, the High Court of the Solomon Islands, the Solomon Islands Court of Appeal and the High Court of Fiji and his practice has extended to acting in matters involving Chinese, Japanese, Korean, Russian, United States, Solomon Islands and Fijian law. A highly experienced alternative dispute resolution lawyer, David also has a strong interest in international commercial arbitration, accepting briefs as both counsel or arbitrator. He is a Fellow of the Chartered Institute of Arbitrators (FCIArb) and panel mediator at the Qianhai International Commercial Mediation Centre.
